GALVESTON – Travis James Mullis performed a sexual act on his 3-month-old son before crushing the infant's skull with his foot, the prosecution said today in the punishment phase of Mullis' capital murder trial.

Mullis also sexually molested a younger female cousin when he was 12, Assistant Galveston County District Attorney Kayla Allen told the same jury that convicted Mullis on Friday.

In her opening statement, Allen asked jurors to condemn Mullis to death. The only other punishment option is life in prison without parole.

Defense attorney Gerald Bourque told jurors that Mullis was molested by his own parents as early as age 3.

"Inside that family, pedophilia is rampant,” Bourque said.

It took 17 minutes for her to post bond and leave the Brazoria County jail. Kohberger, 27, the mother of a 3-month-old boy whose body was found Jan. 29 in Galveston County, flew Friday morning to Houston accompanied by two Brazoria County Sheriff’s deputies, Sheriff Charles Wagner said. She was booked into the Brazoria County Detention Center at 9:20 p.m. Friday and released 17 minutes later after posting $20,000 bond, according to the sheriff’s office Web site. “She appeared in front of a New York court yesterday and chose to waive extradition,” Brazoria County District Attorney Jeri Yenne said. “The state did not oppose a bond reduction, and she was booked into the Brazoria County Detention Center.” Angleton lawyer Jimmy Phillips Jr., who is representing Kohberger, could not be reached for comment Saturday. Kohberger is accused of endangering the life of her son, Alijah Mullis, by giving him to his unstable and potentially violent father, Travis Mulls, at the trailer home in Alvin in which they lived, according to an affidavit on the charge. Kohberger told police Mullis was “freaking out,” having flashbacks to sexual abuse and threatening to hurt one of the children the morning of Jan. 29, when she allowed Mullis to take Alijah, the affidavit states. Later that morning, Galveston police found the body of a baby, later confirmed to be Alijah Mullis, along a roadside in Galveston. Police say Mullis, who surrendered to police Feb. 1 in Philadelphia after a national manhunt, confessed to stomping in the skull of the infant to stop him from crying. Mullis waived his right to an extradition hearing and was brought to a Galveston County jail cell within days. Mullis faces capital murder charges and remains in the Galveston County jail on $1.05 million bond, $50,000 of which is for an unrelated Brazoria County felony charge of enticing a child. “I am hoping for accountability, for full disclosure of what happened to the baby, and we will coordinate with the Galveston County District Attorney’s Office on Mr. Mullis,” Yenne said. Kohberger had been held in a New York City prison hospital since her arrest Feb. 12 by New York City police and FBI agents, where she was found four days after the endangerment charge was filed. She was arrested upon her release from Bellevue Hospital in New York City. Now that Kohberger has been formally arrested, the matter can be reviewed by a grand jury. “We want to cover all bases,” Yenne said. “As with any criminal case, we want to make sure everyone is held accountable.” Nathaniel Lukefahr covers Alvin for The Facts.
