Well some of you are aware of the troublesome bitch of a ex-girlfriend I am involved with because of my son Daniel. Well back in November during a custody exchange I was accussed of threatening her with 'getting my tire iron and using it to get to her'. Remember that line right there as there will be mention of it a little bit later in this blog.
Well she accussed me of it and a warrent for my arrest was done. On the following Monay morning I was arrested by the Wayne County Sheriff's Department at around 715am. She knowing did this in an attempt to have me arrested in front of our son. What she didn't realize was that the sheriff knew due to a previous warrent that my children may be present so they allowed me time to make sure they were off to school. This was much appreciated by me and my parents. Since the warrent was done in Johnston county I was transported to the county line and changed cars to the Johnston County Sheriff. I arrived at the jail and within an hour I was released by posting yet another bond. 10,000.00 in bonds to date because of her inability to work with the custody and realize that it is necessary for us to get along civilly for the sake of Daniel.
I was appointed a lawyer as I never know when or where she will file another worthless warrent based on no evidence. The system of law is truly messed up and true evidence should be required. But that is not what this is about.
So yesterday we had the hearing for the violation. She was truly amazing as was her boyfriend. Both lied beyond anything I have ever heard in my entire life. Neither one told anywhere near the same story nor were the lies even close. By them the story goes as this:
They arrived at the Smithfield PD at 3pm on the 23 of Nov. they parked about 4 spaces away from where I was parked at with my mom. I was on the phone ranting and raving and shortly hung it up to continue the ranting directed at them. I was yelling for 'Daniel get out of the damn car' 'Mommy is going to jail' over and over again, then by them I approached the car and stated 'open the damn door or i am going to get the tire iron and (this is where the lies really got confused) (he stated) break the window and get Daniel out (she stated) and get to you'. I then took while being total pissed off started walking to my car to get it an dmy mother had to physically restrain me and calm me down.
That was their story.
The truth of the matter is:
They arrived at first off 302pm 2 mins after the court ordered exchange time and I was on the phone, to my lawyer telling her they were late. I did call Daniel, I simply said , "come on Daniel, lets go home" a few times. When I could visiblely see Daniel trying to open the door and unable to. I then said " Mike unlock his door. all this is going to do is get her arrested". He didnt, I then asked mom to walk over an dsee if she would unlock it for her. Mom approached th ecar and tried one time to open the door , then while she was there th eex was yelling on the phone " she is coming to the car, i dont knwo what she will do" over an dover again in her want to be upset voice( she is a good actor). Mom came back to her car and waited for the officer to show up. We were parked directly in front of the police station front doors and I never moved past the front if the car. Finally a officer arrived and I presented him with the custody order and made it clear if need be he was ot forceably remove my son from her custody. It was 312pm when finally I was given Daniel and we left the station parking lot.
On the stand she stated tha" he was goign to get the tire iron an dbreak the window out to get Daniel." On the warrent she stated that "i was going to get the tire iron to get to her". Do not see where one is the same as the other. The DA tried to explain to her befor ethe hearing that it would be best to let this drop and not proceed. The ex made it vey clear she wanted me in jail and to proceed with the hearing against the DA's better judgement. SO we proceeded with the hearing. We had our say and it became clear that it was not about me and a violation but abou tthe fact next thrusday the 17th we have a custody hearing and she is grabbing at straws to try and make me look bad before it. This isnt abou tbeing in fear but about spite and being vindictive. SHe has no thought of our son, but that of usuing him to attack and hurt me. She is in my opinion using him as a pawn in this game of hers.
My son is no pawn. I have done everything I can to make sure she has been in his life since originally I was granted custody in Oct and she was given no visitation at the time. It wasnt until the following monday when I told my lawyer no matter what I wanted her to be able to see him ,was it done. I could have been as vindictive as she and made it clear I wanted her to have nothing to do with him, but I thought of Daniel first and wanted him to be able to spend time with his mother.
As for the verdict yesterday on the charge of threatening her..
NOT GUILTY
SO there is the justice in the court system. They can see the truth and see the lies. Thank God for the system!!!
