Michale Graves WM3 WAD Statement November 12-19, 2006 has been designated West Memphis Three World Awareness Week. All across this country and internationally, people will coordinate and hold events to raise awareness for and support the fight to free Jason Baldwin, Jessie Misskelley Jr, and Damien Echols, innocent men, persecuted by men of law and power in West Memphis, Arkansas. Damien has been sentenced to death for a crime no one proved he committed. The awful reality of all this has also robbed the three young boys who were murdered the justice they deserve as well. Chris Byers, Steven Branch, Michael Moore and their families deserve justice, where there has been none so far. To what level of moral bankruptcy have we fallen? If we as a society turn our eyes away from Damien and these issues, how far has our judiciary system fallen that a court will allow killing a man on a procedural basis, rather than on the merit of his claims? No where is this fight more important than right here in Arkansas because that is where Damien is, this is where the murders happened. On November 16 - 18 I will come to Arkansas and participate in several events to educate, provoke thought and inspire Arkansans to work for a popular mandate by engaging citizens about capital punishment and the WM3. Together we can begin to affect legislative reform and protect innocent people like Damien Echols from being killed legally by the courts that should be protecting him. All across this country and overseas, the overwhelming support for Damien, Jason and Jessie continues to grow. It is important now to collectively use our voices and act to awaken the state of Arkansas to the miscarriage of justice that has been going on for over 12 years. The case of the West Memphis Three is a glaring example of the broken system of capital punishment in America. It remains a predominantly southern practice that goes back to the days of slavery. The southern states account for 80 percent of US executions. In 1997, the American Bar Association found such stunning unfairness in the application of the death penalty, that they called for a moratorium. Their concern was about “due process” and “equal justice under the law”. In 1994, Supreme Court Justice Harry Blackmun, who voted to reinstate capital punishment in 1976 changed his mind and voted to overturn death sentences, saying its random application was unconstitutional. In his famous dissent in Callins vs. Collins, he says that he could no longer “tinker with the machinery of death”. There is more evidence of the innocence of the West Memphis Three than of their guilt. A growing number of people are being awakened to the injustice that continues to take place. It is time to act because these men are innocent. Honorable people have disagreed about the justice of executing the guilty, but can anyone argue about the justice of executing the innocent?
