The baby can't even walk yet, but she's already been kicked out of a fast food restaurant for not wearing shoes.

"No shoes, no shirt, no service!" That's what the mother of 6-month-old Kaylin Frederich was told by the manager of her local St. Louis, Missouri, Burger King when she tried to order a Whopper.

Local FOX affiliate KTVI reports that Kaylin, her mom, Jennifer, and Jennifer's mother were booted from the restaurant due to "health concerns." The infant, Jennifer says, is too young to even crawl, and her feet are too small for shoes. "Everybody loves baby feet!" she said.

She says when she was standing at the counter ordering, the manager told her, "You can order 'to go' but you're going to have to leave if she doesn't have shoes on.' He said, 'It's against health code.'"


Jennifer said she was with her church youth group on their way to a concert. Her mother went into the establishment first; then she followed with the rest of the group. "The guy was still saying, 'That lady is still here with that baby without shoes,'" Jennifer said. "I just looked at him and I said, 'That's my daughter. She doesn't own shoes. She's only 6 months old' ... she doesn't walk. She's not touching the ground. So there's no reason for her to have shoes on!"

Kaylin's mom said she put socks on the baby's feet to try to comply with the manager's request, but the manager threatened to call the police, so the group ate hurriedly and left. Jennifer says she posted her story on Facebook and had dozens of responses.

Burger King issued a statement saying they were "retraining" its franchisees on the "no shoes, no service" policy.

Digging Up Dad

THETFORD, Vt. -- A Vershire man has been accused of digging up his father's remains and bringing them home with him because he missed his late father.

 

Dominik A. Bailey Jr., 43, has been charged with felony removal of human remains after allegedly digging up the cremated man's remains from a Vershire graveyard.

 

Thetford police said they received a call from Bailey's mother on Friday telling authorities that she believed her son had gone and dug up her husband's cremated remains, taking the remains and the headstone home with him. The mother said she was going to check the grave site and later told police all she saw at the site was a hole in the ground.

 

According to court papers, Bailey phoned his aunt in Connecticut admitting he took the remains home. The aunt said Bailey had talked about taking his father's remains home for months, but said she did not believe he would actually do it. The aunt also told police Bailey has made several threats to shoot relatives.

 

The aunt said Bailey left a message on her answering machine Friday saying that he was "going to get his father" and that the family "didn't need to leave flowers there anymore," according to court papers. The aunt also told police Bailey phoned her again later in the day and spoke with her, saying "he's here with me now" and that his father's remains were in his living room, along with the father's headstone.

 

On Saturday, a man who lives near the cemetery said a man -- who police suspect was Bailey -- asked him to borrow his wheelbarrow, returning the wheelbarrow after taking it to the cemetery.

 

Police searched Bailey's home and recovered the remains and headstone of his late father. Bailey was not home at the time, but was pulled over by police in Thetford and taken into custody. He is being held at the Orange County Sheriff's Office and is scheduled to appear in court Monday.

 

The charge of felony removal of human remains carries a sentence of up to 15 years in prison and a fine of not more than $10,000.

CNN) -- A 44-year-old Maryland woman faces charges of child abuse after police say she gave birth in a portable toilet and dropped the newborn into the waste tank.

After exiting the portable toilet in Long Wharf Park in Cambridge, Candy Vigneri got a cigarette from a construction worker and sat at a picnic table, police Lt. Wayne Bromwell said.

As she sat, a male passer-by approached the toilet but Vigneri warned him, "Don't go in there, I just had a baby there," police said.

The man immediately called 911. Vigneri returned to the toilet and retrieved the newborn from the foul liquid at the base of the tank.

The baby was unresponsive and covered with a blue antibacterial chemical agent when emergency responders reached the scene, police said.

Vigneri told officers that she didn't know she was pregnant.

She was arrested Wednesday on charges of child abuse and reckless endangerment and is being held on a $50,000 bond.

The baby is in stable condition at Easton Memorial Hospital. Dorchester County social services will take control of the newborn after she is released from the hospital.

SPOTSYLVANIA, Va. -- A Spotsylvania man's family turned him in to police after he admitted to "fooling around" with the family dog, according to the Spotsylvania County Sheriff's Office.

Robert John Ward, 66, was arrested Monday for alleged bestiality. Deputies began investigating Ward after a family member called authorities with the allegation.

Ward admitted to a deputy that he had touched the dog inappropriately and that he'd had the dog perform sexual acts on him, according to the sheriff's office.

A vet examined the dog and found that her anal glands were swollen, the sheriff's office said.

The accusing relative said the dog had been acting strange for several weeks.

Ward's being held without bond at the Rappahannock Regional Jail.

HOUSTON – A Texas death row inmate with a history of mental problems pulled out his only good eye and told authorities he ate it. Andre Thomas, 25, was arrested for the fatal stabbings of his estranged wife, their young son and her 13-month-old daughter in March 2004. Their hearts also had been ripped out. He was convicted and condemned for the infant's death. While in the Grayson County Jail in Sherman, Thomas plucked out his right eye before his trial later in 2004. A judge subsequently ruled he was competent to stand trial. A death-row officer at the Polunsky Unit of the Texas Department of Criminal Justice found Thomas in his cell with blood on his face and took him to the infirmary. ""Thomas said he pulled out his eye and subsequently ingested it," agency spokesman Jason Clark said Friday. Thomas was treated at East Texas Medical Center in Tyler after the Dec. 9 incident. Then he was transferred and remains at the Jester Unit, a prison psychiatric facility near Richmond southwest of Houston. "He will finally be able to receive the mental health care that we had wanted and begged for from day 1," Bobbie Peterson-Cate, Thomas' trial attorney, told the Sherman Herald Democrat. "He is insane and mentally ill. It is exactly the same reason he pulled out the last one." At his trial, defense lawyers also argued he suffered from alcohol and drug abuse. Thomas does not have an execution date. The Texas Court of Criminal Appeals in October upheld his conviction and death sentence for the death of 13-month-old Leyha Marie Hughes. Also killed March 27, 2004, were his wife, Laura Christine Boren, 20, and their son, 4-year-old Andre Lee. Thomas, from Texoma, walked into the Sherman Police Department and told a dispatcher he had just murdered the three and had stabbed himself in the chest. Thomas told police how he put his victims' hearts in his pocket and left their apartment, took them home, put them in a plastic bag and threw them in the trash. Court documents described the three victims as having "large, gaping wounds to their chests."

Clay Aiken is expanding the ranks of the Claynation by one, expecting a child with music producer Jaymes Foster this summer. The sister of music kingpin David Foster, the baby mama is a Grammy winner who worked with Aiken on several albums, including A Thousand Different Ways and his most recent release, On My Way Here. A rep for David Foster confirmed what TMZ first reported this morning, that the couple certain to be dubbed Faiken conceived via artificial insemination and their progeny is due in August. "She looks great, glowing and very happy. She and Clay have been good friends for a long time," the rep told The Insider. There was no immediate comment from Aiken's camp. The couple has kept a decidedly low-profile. Indeed, until news of the impending spawn broke today, there had been virtually no clue that the two had made sweet music anywhere other than the recording studio. DEEPWATER, Mo. -- Officials were trying Tuesday to decide whether to file charges against a Missouri man who fatally shot his wife while trying to install a satellite TV system in the bedroom of their home. Patsy Long, 34, of Deepwater, died after being shot in the chest with a .22-caliber handgun on Saturday. Her husband, Ronald Long, fired the shot from the inside of their home after several unsuccessful efforts to punch a hole through the exterior wall using other means. Henry County sheriff's deputies said the woman was hit by the second of two shots fired by her husband. Long was given CPR by neighbors and family until medics arrived, police said. She was transported by air ambulance, but was pronounced dead at the hospital just after 6 p.m. He was under the impression that everybody was inside the residence, that he knew where everybody was at,” said sheriff's department spokesman Maj. Robert Hills. Hills said a person involved in such a case normally would be charged with manslaughter, but that would be up to the prosecutor. "Once we complete a diagram of the incident, we will be submitting everything to the prosecuting attorney and let him decide if he wants to press criminal charges," Hills said. Henry County Coroner Scott Largent declined to release details about Patsy Long's death until the sheriff's department completes its investigation. On Tuesday morning, Henry County Prosecuting Attorney Richard M. Shields said he has yet to receive the case from the sheriff's department. Neighbor Mark Lassince said he believed it was a tragic accident. "Bad things happen to good people,” Lassince said. Patsy and Ronald Long were raising their two children in their rural home overlooking Truman Lake. "I was in the shower, and the son came in and told me his mom had been shot, so we went up there to see if we could help,” Lassince said. But as he left the shop, a gust of wind pulled the balloon from his hand and he watched the ring -- and quite possibly the affections of his girlfriend -- sailing away over the rooftops. "I couldn't believe it," he told The Sun newspaper. "I just watched as it went further and further into the air. "I felt like such a plonker. It cost a fortune and I knew my girlfriend would kill me." Hajji spent two hours in his car trying to chase and find the balloon, without success. WICHITA, Kansas (AP) -- A 35-year-old woman who sat on her boyfriend's toilet for so long that her body was stuck to the seat had a phobia about leaving the bathroom, the boyfriend said. She is an adult; she made her own decision," said her boyfriend, Kory McFarren. "I should have gotten help for her sooner; I admit that. But after a while, you kind of get used to it." The case drew nationwide attention after Ness County Sheriff Bryan Whipple said it appeared the Ness City woman's skin had grown around the seat in the two years she apparently was in the bathroom. "We pried the toilet seat off with a pry bar and the seat went with her to the hospital," Whipple said. "The hospital removed it." McFarren, 36, said he can't be certain how long Pam Babcock stayed in the bathroom because "time just went by so quick I can't pinpoint how long." He said beatings she received in her childhood caused her phobia. Watch neighbors describe what they saw at McFarren's home » "It just kind of happened one day; she went in and had been in there a little while, the next time it was a little longer. Then she got it in her head she was going to stay -- like it was a safe place for her," McFarren said. But McFarren said she moved around in the bathroom during that time, bathed and changed into the clothes he brought her. He brought food and water to her. They had conversations and had an otherwise normal relationship -- except it all happened in the bathroom. McFarren said he finally called police February 27 after he became worried because Babcock was acting groggy -- like she didn't know what was going on, except she was awake. What emergency responders found when they went into bathroom has left residents of this small western Kansas town buzzing, and law enforcement officials incredulous. Police found the clothed woman sitting on the toilet, her sweat pants down to mid-thigh. She was "somewhat disoriented," and her legs looked like they had atrophied, Whipple said. "She was not glued. She was not tied. She was just physically stuck by her body," Whipple said. "It is hard to imagine. ... I still have a hard time imagining it myself." She initially refused emergency medical services, but was finally convinced by responders and her boyfriend that she needed to be checked out at a hospital. "She said that she didn't need any help, that she was OK and did not want to leave," he said. Whipple said the county attorney will determine whether any charges should be filed against McFarren. McFarren, who works at an antique store, said he has been taking care of Babcock for the 16 years they have lived together. He insisted that he tried to coax her out of the bathroom every day. "And her reply would be, `Maybe tomorrow,"' Whipple said. "According to him, she did not want to leave the bathroom." She was reported in fair condition Wednesday at a hospital in Wichita, about 150 miles southeast of Ness City. Whipple said she has refused to cooperate with medical providers or law enforcement investigators. Babcock has an infection in her legs that has damaged her nerves, and there is a possibility she may wind up in a wheelchair, McFarren said. James Ellis, a neighbor, said he had known the woman since she was a child, but that he had not seen her for at least six years. "I don't think anybody can make any sense out of it," Ellis said. Babcock had a tough childhood after her mother died at a young age and apparently was usually kept inside the house as she grew up, he said. "It really doesn't surprise me," Ellis said. Surveillance cameras captured the woman holding the girl with one hand and holding the hose in the other hand at an arm's length distance. Marlene Diaz, a manager at Magical Car Wash, said she has never seen this type of abuse before. "You don't do that to a kid," Diaz said. "No child deserves that." The video showed the woman dousing the girl, spraying her in the face and down her legs. The woman continued to grab the girl as she tried to flee. Investigators said they believe the child is 3 years old. The driver of a white Hyundai Sonata shown in the video watched the woman spray the child for a moment before walking away. The video showed the child trying to hide her face while the woman pinned her to a wall and sprayed her at close range. "Disgusted," Diaz said. "I'm mad, infuriated as to how someone could do that to a little child." Investigators said they believe the woman is the child's mother and used the pressure hose as punishment. "The girl probably had some kind of accident in the back seat of the car, maybe urinated or spilled a drink," said Orange County Sheriff's Office Cmdr. Matt Irwin. "God knows what kind of punishment she gets elsewhere." Officials said the water shoots out of the hoses with a force of about 1,200 pounds per square inch, powerful enough to create the type of friction and sting from a rug burn. "Your skin gets red and at times it could peel," Diaz said. Diaz didn't see what happened until she checked the surveillance tapes, but said she heard the girl crying after the mother stopped spraying her. Diaz said she also heard the mother say, "You're going to learn to respect me. You don't treat me bad. You don't mistreat me; I'm your mother." Surveillance cameras showed the women stripped the girl, leaving her standing in the car wash bay naked, while they grabbed a towel and put her back in the car.
