Sad news. Just thought you should know.A San Jose father, accused of killing his 2-year-old daughter, deliberately gave her a deadly dose of a date-rape drug in her sippy cup, investigators said Wednesday.
Minh Phu Le poisoned his daughter Skyla on Friday and attempted suicide with the same drug because he wanted to punish his mistress -- the girl's mother -- for trying to leave him, investigators said.
It was less than a week after he was bailed out of jail on a domestic-violence charge against the girl's mother. He was still on probation for tearing apart a couch with scissors in another rage, court records show.
Police say they have evidence that Le, who has now almost fully recovered, is a GHB and ``ecstasy'' dealer -- selling the drugs in nightclubs. Le's wife and mistress both told police he kept the popular date rape drug GHB in his apartment, court records show.
The 32-year-old was in the jail hospital Wednesday. He is expected to be charged today with murder, prosecutor Matthew Braker said.
``It's hard to imagine a more evil act,'' Braker said.
Authorities still are waiting for a toxicology report to determine what was in the sippy cup and what killed Skyla.
Police, who have interviewed Le, believe he first tried to spike the little girl's bottle, mixing three times the amount adults use to get high in with her juice drink. But Skyla wouldn't drink it. Then he put the straight liquid drug in a sippy cup. Police suspect he made her drink that.
Le could eventually face the death penalty for his alleged crime, marked by a note saying he was ``taking her with me'' and ``she didn't suffer,'' according to a police report filed by detective Sgt. Timothy Porter.
But Skyla did suffer.
The little girl vomited blood, authorities said, as her body tried to cope with the toxic drug -- commonly a mixture of degreasing solvent and drain cleaner that can make users feel drunk or hyper or cause them to pass out.
GHB gained notoriety in the 1990s when it became a drug of choice for sexual predators who used it to drug women into unconsciousness. When it is mixed with alcohol it can cause unconsciousness and blackouts.
The girl's mother -- Le's girlfriend of five years -- came home Friday after Le left her an ominous voice-mail message. He warned she had better call him and that he had a ``surprise'' for her when she returned home, the court document said.
Serena Garcia found her little girl foaming at the mouth Friday night in the downstairs apartment Le shared with his wife. Le was unconscious nearby.
When she picked Skyla up and saw that she wasn't breathing, she began to scream.
In the home, police found a green sippy cup lying next to the couch and a flowered baby bottle half-filled with green liquid. Someone had written ``GHB'' on it.
Police are testing both containers, but they are both suspected to contain high concentrations of the clear-liquid drug.
Le's wife, Sonia Le, confirmed to police that he kept the drugs around the home, Porter wrote. She and Serena Garcia were friends, who lived in adjacent apartment units, often spending holidays together, according to police and neighbors.
``After this one I have seen it all,'' said police Lt. Jr. Gamez, who heads the city's homicide unit. ``Here is an absolute 2-year-old angel that falls victim to a person that is supposed to be protecting her.''
But Le had threatened to hurt the child many times before, court documents said, telling Skyla's mother he would hurt her ``in the worst possible way'' by poisoning the child with a drug.
Garcia told police that she doubted he ever would follow through.
Le had a recent history of domestic violence, including a case that was still pending.
At the time of the poisoning, Le was out on bail awaiting a hearing on domestic-violence charges that he choked Garcia and pushed her to the floor Nov. 26, just days before his daughter's death.
He allegedly attacked her after finding text messages he believed showed Garcia was dating someone else. Le wrapped both hands around Garcia's neck, choking her, according to police reports. He then allegedly threw her against the wall and she fell onto the floor. Skyla begin to cry as her parents struggled, according to the report.
Le's wife bailed him out the next day -- paying $3,500 to secure a $35,000 bond. Five days later, Skyla was dead.
Le was also on probation after being convicted of misdemeanor vandalism for destroying Garcia's couch with a pair of scissors last summer and threatening her sister, Beth Garcia. He pleaded no contest and was sentenced to six days in jail and anger-management classes.
