I have two states butting heads over this case.
Ohio now says that i cant use the protection orders granted by Indiana.
My lawyer says that when i go to court on the 22nd that i have no chance of getting house arrest or probation on the contempt charges and that he dont know about getting a suspended sentence on it. I may have to spend 90 days in jail for protecting my children from an abusive father.
I have asked the lawyer to put my kids on the stand so they can testify as to what goes on in the fathers home.. he says he dont feel comfortable with putting them on the stand. Can i ask for the judge to talk to the judge in chambers. He needs to hear my kids. my kids are 13, 11, and 10.
I am being pulled a million ways. Indiana is filing felony invasion of privacy charges against my exhusband for violating Indianas Protection Order.
I have help from the mental health agency here they are going to advocate for me, because of all the things told to them by my kids and because my kids are threatening to run away if they have to go to dads while im in jail, and my 13 yr old son is threating bodily harm to the ex because of all the hell he has put him through . I have them in counseling and do all i can to help them and i have never talked bad about there father to them or in front of them.
I have police reports on the abuse and violations, drs reports and the magistrate that first hears the case is ignoring them. I believe she is biased against me and making judgments before we go to court and she hears my side. I have tried getting the media involved in this and the newspapers.
It is a teribble tragedy to put childrens lives at stake for the father who is proven abusive, and dangerous! And its also rediculous that i should have to go to jail for 90 days for protecting my childrens lives. I cant afford my own attorney have a court appointed attorney instead. Not sure that he is doing all in his power to help me.
Is it unheard of to give a contempt offender house arrest when they have a gainful job and a handicapped child that needs care, or to give this person probation.
Whats my chances of getting the kids to talk to the judge?
What can I do If I feel that the lawyer is not doing everything to protect me. Can i ask for a new CA Attorney at the hearing and ask for a continuance on a execution of sentencing?
Can this attorney file for a modification of visitation or petition for my divorce to be moved to my state?
He says no but i think otherwise.. i think he dont want to do it just cause of the money he would lose!
Im not sure what else to say.. indiana says if i let him have the kids im putting them in jeapordy and that they will be taken. it seems like a catch 22 thig darned if ya do darned if you dont!
This is in Ohio so i need info based on ohio laws.
please someone give me something I can use.
Oh one more thing the Judge im going to see on the 22nd was contacted by the indiana judge that granted the Protection order and they were in agreement that there was a need for the PO so how can the magistrate ignore it in the same court?
God I am so scared of going to jail and getting hurt , or my kids going to this monster and getting beaten by him.
