Ok first i'll explain a little history, i was with my ex for 2 years, Sierra is his daughter. I've had nothing but problems with him the last two years because i left him after i had sierra. He's an over excessive drinker , who says he's not happy unless he drinks.. Keep in mind what bothers me the most is drinking around our daughter. He hit me and i pressed charges against him in july of 05' he just finally plead guilty to it and now has a no contact order against him in pertaining to me. Two weeks ago i picked up sierra from him and then got a phone call from his dad who he happened to be living with up to this point. His dad called to find out if i had sierra or not because he was afraid that my ex would take off with her and run. At that point he told me that my ex was in some trouble because for the last oh lets say 4-5 months he's been taking his dad's belongings and selling them, and also taking his dad's check book and writing checks off it. His dad said he was pressing charges against him because he wasn't going to let him get away with that, and he's had enough of bailing his son out of his problems. Well none the less his dad wanted to let me know so i would have a chance to make arrangements for my daughter. So me being a single mom i decided to ship my daughter to my mom's for the time being because my ex must have found out his dad was gonna turn him in because he dissapppeared after that. yesterday was two weeks that we hadn't heard from him or seen him. Well he called me, not once but 3 times back to back, and you have to remember there is a NO CONTACT order which means he can't call, email, come to my house, he can't converse with me at all, except for the exchange of sierra's custody drop off/pick up. So i called the cops and reported it. It was right to turn him in, right? Well less than an hour ago he showed up at my door, drunk to boot with someone with me.. It has freaked me out, so i called the cops to have them watch my house and try to find him. In the end they will be issuing a warrant for his arrest because he's broke his no contact order and his probation. But i'm still freaked out because i know he'll come back or call me again. Would i be wrong to go file for full custody in light of that my ex has screwed up? Most likely he will go back to jail (if they can catch him), plus the charges his dad just pressed for forgery are pending.
We currently share custody of sierra, I have primary physical custody of her and he has visitations set and we share the decision making 50% - 50%. Ok this is where i need some opinions and advice....
If you were in this situation would you go file for full custody? OR, should i just go and have the current custody order altered to where he's doesn't have any visitations?
