Burr Oak Update #2

A governor's task force is blaming, in part, a "hodgepodge" of regulations and a lack of enforcement of existing state laws for the body-moving scandal at Burr Oak Cemetery in Alsip, according to a report released Monday. "Part of the reason the Burr Oak situation occurred is that there was nobody watching," said Chicago lawyer Patricia Holmes as she and fellow task force members presented their final report to Gov. Quinn on Monday in the Thompson Center. The nine-member task force, which Quinn named in mid-July, recommends shifting cemetery regulation from state Comptroller Dan Hynes' office to the state Department of Financial and Professional Regulation, which already oversees funeral directors and embalmers. Oversight of the "death care industry" is currently divided between the two state offices. Quinn referred to current cemetery oversight as a "haphazard crazy-quilt system of regulations that doesn't get the job done." "That failure to have that regulatory authority was significant in what happened in Burr Oak," Quinn said. "We don't want it to happen there or anywhere else in Illinois." Hynes, who plans to challenge Quinn for governor in 2010, has sparred with Quinn over Burr Oak. In July, Hynes said Quinn put together the task force to sabotage legislation Hynes backed that would have imposed tough new regulations on the cemetery industry. Task force members Monday denied politics played any role in their recommendations. Still, some members of the task force said Hynes' office had the authority to prevent the Burr Oak scandal. "Absolutely," said state Rep. Ken Dunkin (D-Chicago). "He was the sole regulatory body over cemeteries and funeral homes." Quinn didn't specifically blame Hynes. He said he planned to read the task force's report, adding, "I don't think the comptroller's office should be the regulatory authority." In statement issued Monday, Hynes said, "I appreciate that the task force is recommending many of the reforms that I've long advocated."
